    A client in her 70s was rear ended by another driver and suffered a hip fracture which required a total hip replacement. The insurance company said the fracture was due to her age, not the accident and offered $40,000. Colin was able to show that while she was a candidate for a total hip replacement before the accident, the procedure became a necessity after the accident.

    Colin’s client was an rear ended by another vehicle and the seat belt caused a tear in her shoulder. The insurance company said it was pre-existing and she eventually had surgery. Colin was able to show that the tear was not pre-existing through pre and post- accident examinations.
  • $50,000 – Policy Limits
    A mother was rear ended with her 3 children in the car but the at-fault driver was uninsured. Luckily, she carried a uninsured motorist policy and had a combined total for medical bills of approximately $13,000 for all of them. The insurance company missed the deadline to respond to the demand and Colin was able to successfully argue a violation of Section 541 of the Texas Insurance Code.
  • $30,000 – Policy Limits
    A 6 year old boy was hit by a car after riding his bike into the street of a residential neighborhood. The insurance company denied the claim because the child rode his bike into the street. Colin was able to argue successfully that although that was true, the child did not have the appreciation for the danger and that the defendant had a greater duty to keep a lookout for children in a residential neighborhood.
  • $30,000 – Policy Limits
    Colin’s client was sideswiped by another vehicle and suffered neck and back pain. The insurance company denied the claim saying that the property damage was so minor that it was not possible for our client to be injured. Colin sent a demand for policy limits that was ignored. Therefore, he was able to argue a violation of the Stowers Doctrine for failure to evaluate and make a reasonable offer by the deadline.
